A Chicago court presided over by Judge Nancy L. Maldonado has ordered Chicago State University to release all of Tinubu’s documents on Monday to Atiku Abubakar, who is challenging the victory of President Bola Tinubu in the February 25 presidential election at Nigeria's Supreme Court.
In the court’s Memorandum Opinion and Order, the court overruled Tinubu’s objections and adopted Judge Gilbert’s recommended decisions in full.
The court granted the request of Atiku Abubakar to order Chicago State University to produce all privileged documents and records of Bola Tinubu.
In reaching this conclusion, the court emphasized that it expresses no view on the merits of Mr. Abubakar’s underlying claims regarding Tinubu, his graduation from CSU, or the validity of the Nigerian election.
A statement issued by the court reads: “The court simply finds, on the narrow question before it, that Mr. Abubakar is entitled to the production of documents and testimony that he seeks from CSU.
“Respondent CSU is directed to produce all relevant and non-privileged documents in response to requests for production Nos. 1 through 4 (as narrowed by Judge Gilbert and adopted by the District in its opinion) in Mr. Abubakar’s subpoena by 12:00 pm CDT on Monday, October 2, 2022”.
This decision by the court is seen as a setback to attempts by Tinubu's legal team to stop further inquiry about the president's records at the Chicago State University where he graduated from in 1979.
